Illustrator Sidney Sime died in 1941, so according to the ridiculously elongated “70 year rule” on copyrights, his classic horror and Dunsany fantasy illustrations should be in the public domain on 1st January 2012?

Hugh Walpole’s gothic horror novels are also entering the public domain in 2012.
Aren’t they already? I think there’s a rule in the US saying that stuff published before 1923 is PD (hence all the lousy PoD Dunsany reprints that are flooding places like Amazon), and that would cover almost all of Sime’s Dunsany illustrations.
